Terms of use
Last updated: October 5, 2026
1. About these terms
These terms apply when you use withmalta.com or ask Malta for help with individual, family or employer coverage. The site is operated by Malta Health, Inc. and its subsidiary Malta Insurance Services, LLC (in California, Malta Health Insurance Services), a licensed insurance agency (together, "Malta", "we", "us"). By using the site you agree to these terms. Our Privacy Policy explains how we handle your information. Employers that hire Malta sign a separate agreement, and our Employer Services Terms apply to them. Our Medicare site, withmalta.org, has its own terms.
Please read section 11. Unless you opt out, it requires most disputes to be resolved by individual arbitration instead of in court.
2. What Malta does
Our licensed advisors help you understand health coverage options, compare plans, apply, and use your coverage afterwards. Malta is not an insurance company, a health plan or a government agency. Coverage is provided by the carrier or plan you choose, under its own policy documents, and those documents control if anything we say differs from them.
We search every individual and family plan in your area, but we do not offer every plan: we can enroll you only in plans from the insurance carriers we are appointed with in your state, and the same applies to the plans we offer employers. This site is not the Health Insurance Marketplace® website. To enroll in any Marketplace plan, go to HealthCare.gov or your state's marketplace. Plans bought outside the Marketplace are not eligible for its premium tax credits or other cost savings.
3. What Malta costs
Malta is free for individuals and families. Carriers pay us a commission when you enroll in a plan through us, and the amount can differ by carrier and plan. Your premium is the same whether or not you use Malta. Ask your advisor at any time how we are paid for a plan we discuss.
4. Not medical, legal or tax advice
Malta is not a health care provider, and using Malta does not create a doctor-patient relationship. Our advisors are licensed to discuss insurance. We do not give medical, legal or tax advice. When we help you find a doctor, book a visit or understand a bill, the care itself, and every decision about it, belongs to you and your providers.
Estimates of costs, savings, subsidies, networks and covered drugs come from carriers and other sources, and can change; we do not guarantee them. You decide which coverage is right for you.
Do not cancel your current coverage until your new coverage is confirmed in writing by the carrier or plan.
Do not use Malta for emergencies. In a medical emergency, call 911 or go to the nearest emergency room. If you are in crisis or thinking about harming yourself, call or text 988.
5. AI features
Some Malta features use artificial intelligence (AI). Answers in Malta Concierge, our member chat, may come from AI rather than a person.
AI can be wrong or incomplete. Its answers are for information only, are not medical advice, and are not a recommendation of a plan. A licensed Malta advisor makes, and is accountable for, every recommendation about your coverage. Check anything important with your advisor, your plan or your doctor.
We do not use your conversations to train AI models. Our Privacy Policy explains how we handle them.
6. Contacting you
We contact you only in the ways you allowed on our form or told an advisor. Asking for help lets a licensed advisor call and email you about your request. Texts about your request need a separate, optional permission, one more optional permission covers marketing calls and texts, and another covers marketing emails. Reply STOP to any text to stop texts, and use the unsubscribe link in a marketing email to stop those emails. To stop calls or other contact, tell your advisor or email us, and we will stop through every channel you ask us to. Our SMS Terms (withmalta.com/sms) explain our text program. Calls with Malta are recorded.
7. Using the site
You must be at least 18 and in the United States to use the site. Please give us accurate information. If you give us information about someone else, you confirm you are allowed to. You agree not to misuse the site: no scraping, interfering with how it works, trying to access other people's information, or using it to break the law.
8. Our content
The site, its design, text, graphics and the Malta name and logo belong to Malta or our licensors. You may view and share pages for personal use. Please do not copy or reuse them commercially without our permission.
The site may link to carriers, government sites and other third parties. Their sites have their own terms and privacy practices, and we are not responsible for them.
9. Disclaimers and limits on liability
We work to keep the site accurate and available, but we provide it as is. To the extent the law allows, we disclaim implied warranties such as merchantability and fitness for a particular purpose. Nothing in these terms limits rights you have under insurance or consumer protection laws that cannot be waived.
To the extent the law allows, Malta is not liable for indirect, incidental or consequential damages arising from your use of the site, and our total liability to you is limited to the greater of $200 or the amount you paid Malta in the 6 months before the claim. This does not limit our responsibility for our own fraud, gross negligence or wilful misconduct, or any liability that cannot be limited by law.
10. Changes to these terms
We may update these terms. We will post the new version here with its date and, for material changes, give notice on the site. Changes do not apply to a dispute we already know about.
11. Resolving disputes
Talk to us first. Most concerns are resolved by a conversation. Email privacy@withmalta.com or write to 2261 Market Street STE 33206, San Francisco, CA 94114 with your name, contact details and what you would like us to do. We will try to resolve it within 30 days.
Arbitration. If we cannot resolve it, you and Malta agree to resolve disputes by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, instead of in court, except that either of us may bring an individual claim in small claims court. Malta will pay the filing, administration and arbitrator fees beyond what you would pay to file in court. Hearings may be by video or in the county where you live.
No class actions. Claims may be brought only individually, not as part of a class or representative action. If this waiver is found unenforceable for a claim, that claim goes to court and not to arbitration.
Public injunctive relief. Requests for public injunctive relief, where the law does not allow them to be waived, will be decided by a court after any individual arbitration.
Opting out. You can opt out of arbitration within 30 days of first using the site or asking Malta for help, by emailing privacy@withmalta.com with your name and the words "Arbitration opt-out". Opting out does not affect anything else in these terms.
Governing law. These terms are governed by the Federal Arbitration Act and the laws of Delaware, without regard to conflict of law rules. Any claim not subject to arbitration will be decided in the state or federal courts in Delaware, unless the law of the state where you live gives you the right to bring it there.
